Document the Discrimination
Before filing a complaint, start gathering evidence. Save emails, messages, performance reviews, or any written communication that shows discriminatory treatment. Take note of dates, times, and witnesses who may have seen or heard the discriminatory behavior. Documentation is key to supporting your claim.
File a Complaint with the DFEH or EEOC
In California, you can file your complaint with either the California Civil Rights Department (CRD) (formerly DFEH) or the U.S. Equal Employment Opportunity Commission (EEOC). Both agencies work together, so filing with one typically means your claim will be “dual-filed” with the other.
- Deadline: You must file your complaint within three years of the discriminatory act with the CRD. For the EEOC, the deadline is 300 days.
- How to file: You can do it online, by mail, or by phone. You’ll be asked to describe the situation and provide supporting information.
Request an Investigation or a Right-to-Sue Letter
Once your complaint is filed, you can either request that the agency investigate your claim or ask for a Right-to-Sue letter, which allows you to file a discrimination lawsuit in court.
- If you want the CRD or EEOC to investigate, be prepared for a potentially lengthy process.
- If you want to move forward with a lawsuit, a Right-to-Sue letter is required.
